Introduction

This Contract contains the Terms of Agreement between You and Carrier as defined in below "Definitions" herein, on behalf of ourselves and the Yacht you are sailing on, The Yacht's agents, operators, charterers, concessionaires, master, officers and crew, independent contractors, medical staff (who operate as independent contractors) and for everyone else providing anything to us or to the Yacht or to you on our behalf, all of whom are entitled to the same limitations and defenses available to Carrier. The acceptance of this ticket by the person named hereon as Guests shall be deemed to be an acceptance and agreement by each of them of all of the terms and conditions of this Contract. The person purchasing or accepting the contract represents that he or she is authorized by all Guests, including any minor, named herein as guests, to accept and agree to be bound by all the terms and conditions of the contract. This contract may not be modified except in writing signed by Carrier. The terms, conditions and limitations herein shall apply to any and all disputes between you and Carrier regardless whether such disputes arise aboard the Yacht or in any other place, location or mode of transportation whatsoever.

Definition

(a) "Carrier" means and includes the owner, M/Y SAVARONA as a Turkish corporation, operator, Gemi Kurtarma Denizcilik & Turizm A.S. a Turkish registered corporation, its Savarona affiliates, the Yacht, its officers, directors, management, employees, agents, charterers, and tenders.

(b)"You, Your, Guest"" means the person(s) purchasing or accepting this contract or who board(s) the Yacht or those in their care, including their heirs and representatives. The term "You, Your, Guest" shall include plural and the use of the masculine shall include the feminine.

(c)"Cruise" means the voyage from the port of departure to the final port of disembarkment and including any road or sea port, or any package included in the price of or taken in connection with the cruise, any shore excursions or shore side facilities related to or offered during the cruise, and all transportation to or from the cruise if arranged by Carrier.

Important Notice

Any and all information contained herein is in effect at the time of printing and is subject to change at any time. Itinerary arrival and departure times are always subject to change without notice. Savarona shall have the right to cancel or alter the ship's advertised route, to delay any sailing, or substitute or cancel scheduled ports of call, which, in its sole judgment and discretion, is justified for any reason and to do so without liability, for damage or for any loss to guests. Additionally, Savarona reserves the right to cancel reservations and bookings in the event of a full-ship charter or for any other reason, whether or not a deposit or full payment has been received. In such event, Savarona's only liability will be to refund to the guest the amount it has received.
Savarona's responsibility does not extend beyond the vessel and/or tours and transfers outlined in this brochure as being explicitly provided. Savarona is not responsible for incidents such as airline cancellations, re-routings or any disruption of scheduled services and accommodation, or luggage lost prior to embarkation or following disembarkation.
All schedules, fares, and terms and conditions listed in this brochure are effective as of May 2007 and supercede any schedules, prices, and terms and conditions previously published.

Items Included and Not Include in Cruise Fare

Your cruise fare covers all shipboard services including suite accommodation, all on-board meals and entertainment, complimentary beverages aboard ship during all meals (including select wines and sprits), government fees and taxes, airport-port-airport transfers and luggage handling, all shore excursions (including all entrance fees of museums and historic sites and on-shore meals), massage, hair styling and manicures, laundry services. All fares are quoted in US dollars and are per suite based on double occupancy.
Not included in your cruise fare are: pre-cruise or optional hotel accommodation, purchases from the ship souvenir shop, selected champagnes, premium wines and spirit selections, caviar, cigarettes and cigars.

Under normal conditions the cruise fare is guaranteed at the time of booking. However, the fare that you pay is determined far in advance of initial departure on the basis of then-existing projections of fuel and other costs. In the event of any significant change in such costs beyond our control, including but not limited to increases in the price of fuel, currency fluctuations affecting our costs, increases in government taxes or levies, Savarona reserves the right to surcharge passengers to cover such unexpected costs. Savarona has the right to refuse to transport passengers unless the additional surcharge is paid in advance of initial departure.

Unscheduled Embarkment / Disembarkment

International Cabatoge laws may prohibit guests from embarkment or disembarkment their voyage in any port except the main scheduled embarkment and disembarkment ports. If you choose to embark/disembark your voyage at any unscheduled embarking/disembarking port, you may incur additional charges intended to cover any fine or penalty levied against Savarona and other additional costs.

Payment Schedule

To reserve your Savarona cruise, a 30% deposit of the total cruise fare is required within 90 days prior to departure. Full payment is due no later than 30 days prior to departure. Final documentation will be issued upon receipt of final payment. All reservations are subject to cancellation if payments are not received by the due date and are guaranteed only when paid in full 60 days prior to sailing.

Cancellation

Cancellation requests must be made by telephone or in writing to Savarona' s Reservations Department. Cruise tickets must be returned to Savarona before a refund can be processed. If your cancellation request is received more than 120 days prior to your initial sailing date, a full refund of the amount already paid to Savarona will be made. All cancellation requests received within 120 days prior to sailing date, for any reason, including medical reasons, will be subject to the following charges, regardless of suite resales.
120-91 days prior to sailing dates : 5% of the total fare;
90-61 days prior to sailing dates : 10% of the total fare;
60-45 days prior to sailing dates : 30% of the total fare;
45-30 days prior to sailing dates : 50% of the total fare;
30-0 days prior to sailing dates, or non-appearance at the time of sailing :100% of the total fare;
Savarona cancellations penalties are strictly enforced. No refund or adjustment will be made in the event of interruption or cancellation of the cruise after the commencement of same.

Carrier' s Cancellation

A. The Carrier may for any reason whatsoever, with or without advance notice, change the scheduled port of embarkment, omit or change any, some, or all scheduled calls at any intermediate ports, omit or change the scheduled port of disembarkment, call at any port whether or not contemplated in the itinerary, change all or part of any itinerary, as well as transfer the Guest and the Guest's baggage to any other Yacht or convey, whether belonging to Carrier or not, back to the port of embarkment or to the originally scheduled port or disembarkment.

B. The Guest shall have no right to any refund and the Carrier shall have no obligation or liability in respect thereof to the Guest except as follows:

(1) If the scheduled sailing date or time is delayed and you are not accommodated on board, the Carrier may arrange hotel accommodations at no additional expense to you for the duration of the delay,

(2) If the scheduled port of embarkment or disembarkment is changed, the Carrier will arrange transportation to or from the originally scheduled port.

(3) If, in the opinion of the Master, booked accommodations must be changed, the Carrier shall have the right to allocate other accommodations to the Guest.

(4) Should the Yacht deviate from its course for any cause resulting from the Guest's negligence or due to a medical emergency involving the Guest, said Guest shall be liable for the related costs incurred and shall indemnify Carrier for any costs, penalties, or demands arising therefrom.

C. The Yacht' s master may, in his sole discretion, proceed with or without pilots, assist other mariners or Yachts, or make any other modification he in his sole discretion deems necessary or appropriate for the safety of the Yacht or its Guests and crew, including but not limited to changes in itineraries or routes.

Force Majeure

Except as otherwise provided herein, Carrier shall not be liable for delay or inability to perform this contract or any part thereof caused by or arising out of strikes, lockout or labor difficulties or shortages whether or not the Carrier is party thereto, or explosion, fire, collision, standing or foundering of the Yacht or breakdown or failure of or damage to the Yacht or its hull or machinery or fittings howsoever and wheresoever any or the same may arise or be caused, or civil commotion, riot, insurrection, war, government restraint, requisitioning of the yacht, political disturbance, acts or threats of terrorism, inability to secure or failure or supplies including fuel, acts of God, or other circumstances beyond the carrier' s control. In all such events, however, the provisions of paragraph "carrier's cancellation" as applicable shall prevail.

Health and Medical Requirements

All guests are required to report in writing to Savarona at the time their reservation is made:

1. Any physical or mental condition that may require medical or professional treatment or attention during the voyage;
2. Any condition that may render the guest unfit for travel, or that may require special care or assistance;
3. Any condition that may pose a risk or danger to the passenger or anyone else on board the ship;
4. Any condition that may require oxygen for medical reasons; or
5. Any intention or need to use a wheelchair on-board ship.

By booking passage and by boarding the ship, the guest represents and warrants that he/she is physically and otherwise fit to travel, and that the guests will comply at all times with applicable rules and regulations of the ship and orders and instructions of the ship' s officers and medical staff. Savarona reserves the right without liability to require a guest to disembark or to refuse to board and transport a guest who, in the judgement of Savarona or the ship' s Master or Medical officer, is unfit to travel or may require care beyond that which Savarona is reasonably able to provide. Savarona strongly recommends

wheelchair guests travel with someone who is able to assist them both on-shore and at sea as Savarona may be unable to offer special assistance. Wheelchair guests must bring their own wheelchair and we strongly recommend a collapsible wheelchair. Savarona bears wheelchair for emergency use only.

Pregnancy

At the time of booking, expectant mothers are required to supply a medical certificate establishing their fitness for travel at the time they are due to travel. Savarona is unable to accommodate women beyond their sixth month of pregnancy and will not be reponsible or liable for any complication relative to any pregnancy during the entire duration of the cruise.

Personal Injury, Illness, Death

Savarona is not liable for death, injury (including mental anguish), illness, damage, delay or other loss to property of any kind caused by act of God, war, civil commotions, labor trouble, governmental interference, perils of the sea, fire, thefts or any other cause beyond Savarona' s reasonable control or any other act not shown to be caused by Savarona' s negligence. If you use the Yacht's athletic or recreational equipment or take part in organized activities, whether on the Yacht or as part of a shore excursion, you assume the risks of injury, death, illness or other loss, for which Savarona is not responsible.

Baggage and Personal Effect

You may bring aboard the ship a reasonable amount of baggage without charge. Baggage for Savarona guests or guests on land programs, must be handled in accordance with regulations and tariffs of airlines and/or ground operators. Baggage exceeding these limitations is subject to the charges as set forth by the individual operators. Airlines are strict with baggage limitations. Guests are encouraged to contact individual airlines for weight limitations. All baggage must be securely packed and properly and clearly labeled, unsuitably packed baggages are transported at your own risk. Savarona is not responsible for loss or damage to baggage or any other personal item during air travel and land programmes or shore excursions.
Baggage and personal belongings will be taken off the ship upon guest disembarkation. Under no circumstances will baggage be stored on-board without the owner of such baggage being on the vessel. Savarona is not responsible for baggage stored in shoreside facilities.
Under no circumstances may dangerous items (i.e., including but not limited to explosives, firearms, combustible or illegal substances) be taken aboard the ship. Savarona's officers and crew have the right to enter and search your suit, baggage or person for any hazardous, controlled or prohibited substances or items.
We recommend that you hand carry travel documents (passport, visa, cruise tickets), medications and valuables. These items are the full responsibility of the guest at all times. Savarona shall not be responsible for the loss of, or damage to, such personal items, cash, negotiable securities, documents, jewelry, computers, electronics, tools of the trade or product samples whether kept in the cabin, in the guest's baggage, in the Yacht's safe or security boxes or otherwise. Items stored in the Yacht's safety deposit boxes are subject to the same limitations as set forth above. Under no circumstance will Savarona be responsible for loss or damage to any item placed in the security boxes unless the identity of the valuables and their value have been declared in writing by guest. Savarona does not undertake to carry as baggage any money, valuables, precious stones, gold or silver,etc. If any such goods are contained in baggage, Savarona shall have no liability with any respect to them in any other capacity, either for the negligence or otherwise.

Personalities, Travel Agents and Other Independent Contractors

Independent contractors retained by Savarona, including but not limited to guest personalities, cruise hosts and entertainers are subject to change and/or cancellation without notice.

Any Travel Agent utilized by Guest in connection with the issuance of this ticket or otherwise making arrangements for air transportation, or shoreside accommodations and meals prior to embarkation or following disembarkation, provides such services as an independent contractor except in such cases that those hotel arrangements were made by Savarona or its assignee. Savarona accepts no responsibility for any acts, omissions, or the financial condition or integrity of any travel agent utilized by the guest in connection with your cruise.

Guest Safety

The Guest admits a full understanding of the character of the Yacht and assumes all risks incident to travel and transportation and handling of Guest and cargo. The Yacht may or may not carry a physician or other medical personnel at the election of the Carrier. While at sea or in port the availability of medical care may be limited or delayed. Guest acknowledges that all or part of their voyage may be in areas where medical care and evacuation may not be available or may be significantly delayed.
Carrier's Yacht visits many destinations. Carrier reserves the right to alter or cancel itineraries, with or without notice for any reason, including but not limited to in the interests of security and safety. However, Guests must assume responsibility for their own safety and Carrier cannot guarantee Guest's safety while on or off the Yacht. Carrier strongly recommends Guests obtain and consider such information when making travel decisions. Guests also should consult all appropriate governmental agencies and authorities to determine if any vaccines or special medical provisions or recommendations apply to the regions Guests anticipate visiting. Carrier assumes no responsibility for gathering such information.

Travel Documents

All travel documents (air and cruise tickets, passport, medical card, inoculation verification) are the guest's responsibility. It is also guest's responsibility to obtain any necessary visas and public health documents and to comply with all customs requirements. Without the required documents, a guest may be denied boarding, and Savarona will not be liable for such denial or bear any financial responsibility. Please check with Turkish Consulate for specific requirements.
Security measures imposed by governments may change from time to time and each guest will be required to comply with them. We will endeavor to provide each guest with notice of measures which may affect them, but complying with any such requirements is the responsibility of each guest. Please consult your travel agent for advice on such requirements to avoid loss of boarding privileges.

Third Guests

Third guests who are sharing with two people in any given suite will pay 25% of the suite price. Fares and supplements are subject to change without notice based on availability.

Extended Voyages

Combine two consecutive voyages and save an additional 15% on total price. Savings are subject to change or withdrawl without notice.

Smoking

Smoking on Savarona is only permitted outside on the deck. It is forbidden to smoke in any location inside the ship.

Children

No children under the age of twelve (12) years will be accepted as passengers. Any guest under the age of eighteen (18) years must be accompanied at all times by an adult guest over the age of eighteen (18). If the adult is not a parent, a Parental/Guardianship Consent must be signed by the minor's parent or legal guardian and delivered to the carrier (Savarona), forty-five (45) days before sailing. Parents and/or Guardians, as specified above, agree to fully supervise any and all children accompanying them during the cruise. You also agree to indemnify carrier (Savarona) for any and all damage caused by such child or children, for any injury, illness or death to such child or children to which lack of adequate and proper adult supervision contributed in whole or part.

Pets

No animals will be allowed on Savarona under any circumstances unless deemed necessary to assist with physical disability and provided the carrier (Savarona) is given advance notice that said animal will be carried aboard. The guest assumes all responsibility for said animal's food and hygiene, and agrees to indemnify and defend carrier (Savarona) should the assistance animal cause injury, death, damage or loss to any other guest or crew or to the yacht. Guests using assistance animals should check in advance with governmental authorities in each port to be visited to determine local rules, regulations, fees and quarantines applicable to such animals.
